These Terms of Use (“Terms”) govern your use of Pearl Orchids (“We” or “Us” or “Our”) website and/or mobile application (collectively, the “Platform”). By accessing or using the Platform, you (“User” or “You”) agree to be bound by these Terms. If you do not agree, please do not use the Platform.

This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.

This electronic record is generated by a computer system and does not require any physical or digital signatures.

1. ELIGIBILITY

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are competent to contract under applicable law. If you are below 18 years, you may use the Platform only with the involvement of a parent or guardian.

2. ACCOUNT REGISTRATION

(a) To access certain features, you may be required to register and create an account by providing accurate and complete information.

(b) You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities that occur under your account.

(c) You agree to immediately notify Us of any unauthorised use of your account.

(a) Pearl Orchids provides orchid plants and related products through the Platform. Product descriptions, prices, and availability are subject to change without notice.

(b) All prices are displayed in Indian Rupees (INR) unless otherwise stated.

(c) We reserve the right to refuse service, limit quantities, or cancel orders at Our sole discretion.

4. ORDERING AND PAYMENTS

(a) By placing an order on the Platform, you agree to provide accurate billing, shipping, and contact information.

(b) Payments may be processed through third-party payment gateways. By making a payment, you agree to comply with the terms and conditions of such payment providers.

(c) We shall not be liable for payment failures, delays, or security breaches arising out of third-party payment services.

5. SHIPPING AND DELIVERY

(a) Delivery timelines provided are estimates and may vary due to external factors beyond Our control.

(b) Risk of loss and title for purchased items pass to you upon delivery of the items to the carrier.

6. CANCELLATION, RETURNS, AND REFUNDS

(a) Orders may be cancelled or modified only before they are shipped.

(b) Returns and refunds will be accepted only in accordance with Our Return & Refund Policy (if applicable).

(c) Perishable products such as live orchid plants may not be eligible for return once delivered, except in cases of damage during delivery.

7. USER OBLIGATIONS

By using the Platform, you agree not to:

(a) Violate any applicable law or regulation;
(b) Infringe upon intellectual property rights of Pearl Orchids or third parties;
(c) Post, upload, or transmit any harmful, unlawful, defamatory, or obscene content;
(d) Interfere with the security or functionality of the Platform;
(e) Attempt to gain unauthorised access to accounts, systems, or networks connected to the Platform.

8. INTELLECTUAL PROPERTY

(a) All content on the Platform, including but not limited to text, images, graphics, logos, product descriptions, and software, is the property of Pearl Orchids or its licensors.

(b) You may not copy, reproduce, distribute, or create derivative works from the Platform content without prior written permission.

9. THIRD-PARTY SERVICES

The Platform may contain links or integrations with third-party websites, applications, or services. Pearl Orchids is not responsible for the availability, accuracy, or practices of such third parties, and your use of third-party services shall be governed by their terms and policies.

10. DISCLAIMER OF WARRANTIES

The Platform, its content, products, and services are provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Pearl Orchids shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Platform.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Pearl Orchids, its affiliates, officers, employees, and agents from any claims, damages, liabilities, or expenses arising out of your use of the Platform or your violation of these Terms.

13. TERMINATION

We may suspend or terminate your access to the Platform without prior notice if We believe you have violated these Terms or applicable laws. Upon termination, your right to use the Platform will immediately cease.

14. MODIFICATION OF TERMS

We reserve the right to modify these Terms at any time. Any changes will be posted on this page. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

15. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. You agree to submit to the exclusive jurisdiction of the courts located in Thrissur/ Kerala.
